Secure Act 2.0 – What Should Employers Understand?
October 11, 2023

Registration

There is still a notable amount of uncertainty from an administration and implementation perspective, as additional agency guidance and clarity is needed (e.g., IRS, DOL guidance/direction).

It is helpful to think of the provisions from a mandatory (near term) vs. optional (medium term) perspective and prioritize the administration and operational aspects of the mandatory provisions, much of which will be facilitated by record keepers.

Strategic consideration of the optional provisions relative to all available employee benefits is critical. While many provisions may appear attractive to employees, they may have unintended effects or administrative and operational hurdles that warrant inspection.
